Analysis of constraints related to federally and stated listed special status species. Consultation services pursuant to the USFWS' section 7 of the Endangered Species Act and the CDFW California Endangered Species Act.
Services include strategy building for efficient project permitting. JMC prepares applications required for the USACE (section 404 of the Clean Water Act and section 10 of the Rivers and Harbors Act), RWQCB (section 401 of the Clean Water Act and the Porter Cologne Act), the CDFW (California Fish and Game Code), and BCDC (Coastal Zone Management Act). Specific expertise in difficult project layouts related to identification of the least damaging practicable alternative (Section 404(b)(1) of the Clean Water Act).
Expertise in compliance with terms and conditions of project authorizations, including mitigation planning and Endangered Species Act take authorization. Negotiation related to non-compliance, unauthorized activities, or enforcement.
Delineation of Waters of the United States
Evaluation and mapping of project sites to determine the extent of jurisdictional waters of the U.S. regulated by the U.S. Army Corps of Engineers and Regional Water Quality Control Board pursuant to sections 401 & 404 of the Clean Water Act, section 10 of Rivers and Harbors Act, and the Porter Cologne Act.
Expertise in identification of appropriate compensatory mitigation for unavoidable losses of waters of the U.S. compliant with the EPA's 2008 Compensatory mitigation rule.
